Ray Epps should spend six months in prison for Jan. 6: federal prosecutors

Federal prosecutors are asking for six months of prison for Capitol protester Ray Epps, who was the subject of conspiracy theories after the U.S. Capitol attacks of Jan. 6, 2021.

In a 29-page sentencing memo this week, prosecutors recommended prison for Epps' role in urging rioters to go into the U.S. Capitol.

"The government recommends that this Court sentence Defendant to six months’ incarceration, one year of supervised release, and $500 in restitution," the memo said. "Such a sentence protects the community, promotes respect for the law, and deters future crime by imposing restrictions on Epps’ liberty as a consequence of his behavior, while recognizing his acceptance of responsibility for his crime, his efforts to deescalate conflicts between rioters and police officers, and his cooperation with the FBI and Congress."

Tucker Carlson and other defenders of Donald Trump suggested Epps was a federal agent who inspired the riot. Those claims were proven to be untrue.

For his part, Epps has asked for six months of probation.

"A probationary sentence is consistent with other sentences in January 6 cases," attorneys for Epps wrote in a filing on Tuesday.

Epps has pleaded guilty to one misdemeanor charge of disorderly conduct.
