Trump attorney says Kavanaugh will ‘step up’ in ballot cases

An attorney for former President Trump, Alina Habba, said late Thursday that she has faith in the Supreme Court and believes that Justice Brett Kavanaugh will “step up” in Trump’s ballot cases in Maine and Colorado.

“I think it should be a slam dunk in the Supreme Court. I have faith in them,” Habba told Sean Hannity on Fox News. “You know, people like Kavanaugh, who the president fought for, who the President went through how to get into place, he’ll step up.”

Habba added that Kavanaugh and the other justices will step up “not because they’re pro-Trump, but because they’re pro-law, because they’re pro-fairness.”

Trump appointed Kavanaugh to the Supreme Court in 2018 in what was seen as a major victory for Republicans. His controversial nomination was marked by sexual misconduct allegations.

Habba’s interview, highlighted by Mediaite, came just a day after Trump’s legal team asked the U.S. Supreme Court to overturn the Colorado Supreme Court ruling that disqualified him from the state’s 2024 Republican primary ballot under the 14th Amendment’s insurrection clause.

Trump also appealed a decision by the Maine secretary of state that kicked him off that state’s primary ballot to its Superior Court.

The insurrection clause of the 14th Amendment, which was added after the Civil War, bars anyone who swore an oath to support the U.S. Constitution but engaged in an insurrection against it from holding office again.

Habba argued during the appearance on Fox News that the clause was added to prevent people who were “pro-slavery, who were anti-American” from taking office. She said in Trump’s instance, “that is not this.”

The lawyer also said Trump has not been charged for the insurrection and has not been found guilty.

The former president also has a trial set for early March in a case brought by special counsel Jack Smith involving his alleged efforts to overturn the 2020 election and exploit violence and chaos at the Capitol on Jan. 6, 2021, to delay certification of the election results.
