Paedophile will not be deported because judge said his crimes ‘did not cause actual harm’
A PAEDOPHILE will be let off deportation because a judge said his crimes “did not cause actual harm”.
Zulquarnain Rafique, who was jailed over his child sex offending, faced being kicked out by the Home Office.
He challenged a removal order to his native Germany and won.
Officials then appealed.
Judge Paul Lodato ruled against them, saying: “It is clear Rafique’s offending did not cause any actual harm, let alone serious harm.”
Tory MP Sir John Hayes said: “This man would not face any horrors in Germany. I find it inexplicable why a judge said this person cannot be deported.”
Rafique, 25, first came before the courts in 2022 for trying to sexually communicate with a girl of 16.
He got a suspended jail sentence and sexual harm prevention order.
But police who installed monitored software on his laptop found he persistently tried to log on to the Habbo virtual world widely used by children.
He also searched for sexually explicit content online.
The repeated breaches of the order meant Rafique, who was granted permanent residence in 2011 aged 13 and lived in Rochdale, Gtr Manchester, was ordered to serve his one-year prison term.
