An Afghan asylum seeker, Rafiullah Ahmadzai, has been sentenced to nine years in prison in Scotland after being convicted of raping a 17-year-old girl in a public park, Scottish authorities confirmed on Tuesday.
Ahmadzai, who arrived in the United Kingdom in 2023 after a perilous journey to claim asylum, denied the rape charge, insisting the sexual encounter was consensual. He was also found guilty of threats and abusive behaviour related to the attack, which occurred in October last year.
Sentencing Ahmadzai, High Court Judge Thomas Welsh in Edinburgh described the assault as “horrifying and violent,” highlighting the serious and lasting trauma inflicted on the victim. The court deemed the lengthy custodial sentence necessary given the severity of the crimes.
Ahmadzai told the court that as a teenager he had joined Afghanistan’s former national army but was later detained by the Taliban after they seized his region. He claimed he escaped Taliban custody with other prisoners, sustaining a gunshot wound to his arm during the escape.
Legal experts note that cases involving asylum seekers committing serious crimes often raise complex questions about deportation and protection. Defence lawyer Shaun Alexander warned that Ahmadzai could face potential deportation after serving his sentence, potentially returning him to a country where his life may be at risk.
Police Scotland said the conviction reinforces their commitment to tackling sexual violence, emphasizing that “Rafiullah Ahmadzai will now face the consequences of his actions.”
Authorities added that the verdict and sentence send a strong message that sexual violence will not be tolerated in Scotland, regardless of an offender’s nationality or immigration status.
The case has attracted attention in the UK media for highlighting challenges within the asylum system while underlining the Scottish justice system’s stance on protecting victims and punishing serious crimes.
