Video shows firefight in which Clackamas County deputies shoot, kill suspect
An intense firefight between a suspect and authorities last year was captured on various law enforcement dash cameras and a home's surveillance camera.
The suspect, 44-year-old Nathaniel Fritz Macalevy of Boring, was found dead outside a barn in the early morning hours of Tuesday, Dec. 26, 2017. He had been shot and killed by deputies.
After a grand jury reviewed the evidence in the shooting, the Clackamas County District Attorney's office said it would not pursue charges against the law enforcement personnel involved in the shooting.
The long night started after Clackamas County sheriff's deputies responded to a restraining order violation Dec. 25. Macalevy's wife, who had gotten the order prohibiting Macalevy from contacting her and her daughter, told authorities her husband was armed with a rifle, dressed in full camo, wearing a military tactical vest with ballistic plates, had extra magazines and a Kevlar helmet.
At about 4:41 a.m. Dec. 26, after spotting him driving his work van, deputies chased Macalevy along snow lined and snow covered roads to his rural rental property on Southeast 312th Avenue in Boring.
Macalevy stopped his van in his driveway, got out and started firing at deputies with an AR-15 rifle. Dash cam video showed the bullets hitting the ground and smashing through the windows of a patrol car. The deputy had gotten out safely just moments before the bullets struck the vehicle.
Deputies took cover behind their patrol vehicles as shots rang out. Deputies returned fire. Macalevy got back into his van and drove off.
He stopped his van near a barn, got out and took cover behind it. Deputies and a police officer from Canby opened fire. One of the bullets went through the building and struck Macalevy in the head, killing him instantly.
Authorities said Macalevy's new girlfriend would later tell them that he wanted to be killed by police.
It was determined that Macalevy's blood alcohol level was .12 when he died and that he had fired about 30 rounds during the firefight.
No law enforcement personnel were injured during the incident.
