Judge Puts Hold on Move to Drop Flynn Case

The federal judge overseeing the case has put the Justice Department’s move to drop the criminal charges against Flynn on hold to give outside legal experts a chance to argue against the department’s decision, VOA reported

Judge Emmet Sullivan said late Tuesday that “friends of the court” will be able to file briefs and that he will set up a time to hear those arguments “at the appropriate time.”  

Sullivan could decide to call witnesses to testify and answer questions about the Justice Department’s move last week to drop the charges against Flynn, and possibly reopen the entire case months before a presidential election, according to the VOA report.

The Trap:

“This is law enforcement abusing its most tyrannical power—to strip citizens of their reputations, their livelihoods and their liberty,” Kimberley A. Strassel in the WSJ said of the FBI investigation into President Trump’s Former National Security Advisor General Michael Flynn.

The case centered around the FBI and DOJ’s attempt to prove that Mr. Flynn was a Russian agent and at the least colluded with the Russians.

Newly released documents revealed the FBI case against Flynn.

The Case against Michael T Flynn:

COUNT ONE
Description: INFORMATION (A) .

On or about January 24, 2017, defendant MICHAEL T. FLYNN did willfully and knowingly make materially false, fictitious, and fraudulent statements and representations in a matter within the jurisdiction of the executive branch of the Government of the United States, to wit, the defendant falsely stated and represented to agents of the Federal Bureau of Investigation,
in Washington, D.C., that:

· (i)
On or about December 29, 2016, FLYNN did not ask the Government of Russia’s Ambassador to the United States (“Russian Ambassador”) to refrain from escalating the situation in response to sanctions that the United States had imposed against Russia that same day; and FLYNN did not recall the Russian Ambassador subsequently telling him that Russia had chosen to moderate its response to those sanctions as a result of his request; and


On or about December 22, 2016, FLYNN did not ask the Russian Ambassador to delay the vote on or defeat a pending United Nations Security Council resolution; and that the Russian Ambassador subsequently never described to_FLYNN Russia’s response to his request.

In 2017, Michael T. Flynn pleaded guilty in the District of Columbia to making false statements to the FBI pertaining to his communications with the Russian Ambassador to the United States. 

1 May 2019, Michael S. Flynn, executive and co-owner of an insulation contractor, pleaded guilty in Bridgeport, Connecticut, for his role in multiple schemes to rig bids in violation of the antitrust laws and to engage in criminal fraud on insulation contracts, marking the second conviction in this ongoing investigation, the Department of Justice announced.

“In consideration for the benefits offered under this agreement, the defendant agrees to waive his right to be indicted and agrees to plead guilty to a two-count Information, which charges him with: (i) one count of violating 15 U.S.C. § 1 (Conspiracy to Restrain Trade) and (ii) one count of violating 18 U.S.C. § 1349 (Conspiracy to Commit Wire Fraud),” sections of the plea deal read.

In the Statement of Offense filed with his plea agreement, Flynn admitted to making materially false statements in multiple documents filed pursuant to FARA in conjunction with worked performed by him and his company for the principal benefit of the Republic of Turkey. 

Flynn and his co conspirators, accused of collusion in obtaining contracts by stifling the bidding process in CC-1 Company were ordered to make restitution in a plea agreement. Flynn was 50% owner of the company. See the Plea May 2019 Agreement HERE

The Department of Justice later decided to make its own investigation into the highly controversial case. After further investigation, today the DOJ dropped the criminal case against Michael Flynn.

“Thanks to new documents the feds belatedly turned over to his attorneys, we know the FBI engineered this “crime, ” Strassel wrote this week. Handwritten notes from former FBI counterintelligence head Bill Priestap, made before the bureau’s interview of Mr. Flynn, ask the following: “What is our goal? Truth/Admission, or to get him to lie, so we can prosecute him or get him fired?” Wall Street Journal reported.

But the controversy is far from over, as opponents claim that DOD did to drop the case because of its merits, but because of pressure from the Trump administration.
