Full Statement:

Today, President Donald J. Trump signed an Executive Grant of Clemency granting a Full Pardon to General Michael T. Flynn.  The President has pardoned General Flynn because he should never have been prosecuted.  An independent review of General Flynn’s case by the Department of Justice—conducted by respected career professionals—supports this conclusion.  In fact, the Department of Justice has firmly concluded that the charges against General Flynn should be dropped.  This Full Pardon achieves that objective, finally bringing to an end the relentless, partisan pursuit of an innocent man.

General Flynn should not require a pardon.  He is an innocent man.  Even the FBI agents who interviewed General Flynn did not think he was lying.  Multiple investigations have produced evidence establishing that General Flynn was the victim of partisan government officials engaged in a coordinated attempt to subvert the election of 2016.  These individuals sought to prevent Donald Trump from being elected to the Presidency, to block him from assuming that office upon his election, to remove him from office after his inauguration, and to undermine his Administration at every turn.

The prosecution of General Flynn is yet another reminder of something that has long been clear:  After the 2016 election, individuals within the outgoing administration refused to accept the choice the American people had made at the ballot box and worked to undermine the peaceful transition of power.  These efforts were enabled by a complicit media that willingly published falsehoods and hid inconvenient facts from public view, including with respect to General Flynn.  They amounted to a brazen assault on our democracy and a direct attack on our fundamental political values.

While today’s action sets right an injustice against an innocent man and an American hero, it should also serve as a reminder to all of us that we must remain vigilant over those in whom we place our trust and confidence.  The people who sit atop our intelligence and law enforcement agencies have tremendous power to affect the lives of their fellow citizens.  The American people must always take care to scrutinize their actions, to hold them accountable, and to ensure that they use their immense power to uphold the rule of law rather than to harass, persecute, and jail their political opponents in pursuit of partisan political agendas.

UPDATE 24 June: Great! Appeals Court Upholds Justice Departments Request To Drop Criminal Case Against General Michael Flynn! Donald J. Trump

The appellate court issued a write of mandamus.

Flynn petitioned for a writ of mandamus before this court pursuant to the All Writs Act, 28 U.S.C. § 1651, seeking three
forms of relief: (1) an order directing the district court to grant the motion to dismiss; (2) an order vacating the amicus appointment; and (3) an order reassigning the case to a different district judge.

The decision in part:

In this case, the district court’s actions will result in specific harms to the exercise of the Executive Branch’s exclusive prosecutorial power. The contemplated proceedings would likely require the Executive to reveal the internal deliberative process behind its exercise of prosecutorial discretion, interfering with the Article II charging authority. Newman, 382 F.2d at 481 (citing United States v. Cox, 342 F.2d 167, 171 (5th Cir. 1965)). Thus, the district court’s appointment of the amicus and demonstrated intent to scrutinize the reasoning and motives of the Department of Justice constitute irreparable harms that cannot be remedied on appeal. See Cobell, 334 F.3d at 1140 (“[I]nterference with the internal deliberations of a Department of the Government of the United States … cannot be remedied by an appeal from the final judgment.”); see also Cheney, 542 U.S. at 382.
We must also assure ourselves that issuance of the writ “is appropriate under the circumstances.” Cheney, 542 U.S. at 381. The circumstances of this case demonstrate that mandamus is appropriate to prevent the judicial usurpation of executive power……..

Because this is not the unusual case where a more searching inquiry is justified, and because there is no adequate remedy for the intrusion on “the Executive’s long-settled primacy over charging decisions,” Fokker Servs., 818 F.3d at 743, we grant the petition for mandamus in part and order the district court to grant the government’s Rule 48(a) motion to dismiss the charges against Flynn. for the full decision and argument visit the court HERE

May 12 Judge Puts Hold on Move to Drop Flynn Case
The federal judge overseeing the case has put the Justice Department’s move to drop the criminal charges against Flynn on hold to give outside legal experts a chance to argue against the department’s decision, VOA reported

Judge Emmet Sullivan said late Tuesday that “friends of the court” will be able to file briefs and that he will set up a time to hear those arguments “at the appropriate time.”  

Sullivan could decide to call witnesses to testify and answer questions about the Justice Department’s move last week to drop the charges against Flynn, and possibly reopen the entire case months before a presidential election, according to the VOA report.

The Trap:

“This is law enforcement abusing its most tyrannical power—to strip citizens of their reputations, their livelihoods and their liberty,” Kimberley A. Strassel in the WSJ said of the FBI investigation into President Trump’s Former National Security Advisor General Michael Flynn.

The case centered around the FBI and DOJ’s attempt to prove that Mr. Flynn was a Russian agent and at the least colluded with the Russians.

Newly released documents revealed the FBI case against Flynn.

The Case against Michael T Flynn:

COUNT ONE
Description: INFORMATION (A) .

On or about January 24, 2017, defendant MICHAEL T. FLYNN did willfully and knowingly make materially false, fictitious, and fraudulent statements and representations in a matter within the jurisdiction of the executive branch of the Government of the United States, to wit, the defendant falsely stated and represented to agents of the Federal Bureau of Investigation,
in Washington, D.C., that:

· (i)
On or about December 29, 2016, FLYNN did not ask the Government of Russia’s Ambassador to the United States (“Russian Ambassador”) to refrain from escalating the situation in response to sanctions that the United States had imposed against Russia that same day; and FLYNN did not recall the Russian Ambassador subsequently telling him that Russia had chosen to moderate its response to those sanctions as a result of his request; and


On or about December 22, 2016, FLYNN did not ask the Russian Ambassador to delay the vote on or defeat a pending United Nations Security Council resolution; and that the Russian Ambassador subsequently never described to_FLYNN Russia’s response to his request.

In 2017, Michael T. Flynn pleaded guilty in the District of Columbia to making false statements to the FBI pertaining to his communications with the Russian Ambassador to the United States. 

1 May 2019, Michael S. Flynn, executive and co-owner of an insulation contractor, pleaded guilty in Bridgeport, Connecticut, for his role in multiple schemes to rig bids in violation of the antitrust laws and to engage in criminal fraud on insulation contracts, marking the second conviction in this ongoing investigation, the Department of Justice announced.

“In consideration for the benefits offered under this agreement, the defendant agrees to waive his right to be indicted and agrees to plead guilty to a two-count Information, which charges him with: (i) one count of violating 15 U.S.C. § 1 (Conspiracy to Restrain Trade) and (ii) one count of violating 18 U.S.C. § 1349 (Conspiracy to Commit Wire Fraud),” sections of the plea deal read.

In the Statement of Offense filed with his plea agreement, Flynn admitted to making materially false statements in multiple documents filed pursuant to FARA in conjunction with worked performed by him and his company for the principal benefit of the Republic of Turkey. 

Flynn and his co conspirators, accused of collusion in obtaining contracts by stifling the bidding process in CC-1 Company were ordered to make restitution in a plea agreement. Flynn was 50% owner of the company. See the Plea May 2019 Agreement HERE

The Department of Justice later decided to make its own investigation into the highly controversial case. After further investigation, today the DOJ dropped the criminal case against Michael Flynn.

“Thanks to new documents the feds belatedly turned over to his attorneys, we know the FBI engineered this “crime, ” Strassel wrote this week. Handwritten notes from former FBI counterintelligence head Bill Priestap, made before the bureau’s interview of Mr. Flynn, ask the following: “What is our goal? Truth/Admission, or to get him to lie, so we can prosecute him or get him fired?” Wall Street Journal reported.

But the controversy is far from over, as opponents claim that DOD did to drop the case because of its merits, but because of pressure from the Trump administration.
